To Party Colleagues---Re:MA63

*Party Colleagues*

*Re: MA63 SUIT*

Although I have to face legal experts from the Legal Chambers of UK, Malaysia and Sarawak governments, my task in MA63 SUIT is to ensure that we put a good case before the court. They have the resources, manpower, research team all over the country and the world but I am not to give up anyhow.

Whether we could win or not, doesn’t matter.

International law may require us to exhaust all domestic legal avenues before we could move the case to international waters.

I have been doing my own research, collecting materials and reading in preparation of this Suit for the past nearly six years now. The journey began in 2017. It is a struggle, a sacrifice and a journey that I need support but how long I can go on, I don't know.

I know our Almighty God will lead me to safety when in treachery waters. I have faith in our Lord.

I have to work non-stop until early morning and only have 3 to 4 hours of sleep at night doing this case after the Suit was filed, because we have dateline to beat as required by court.

I had consulted a few legal brains whom I could trust and whom I know have the legal expertise in certain areas of law, to put some legal arguments into our case. But it's not easy. Although they are good lawyers, many gave conflicting opinions on issues I asked and conflicting opinions creates doubts and things became more complicated and difficult. But, let us pray for the best to come.

Sometimes, I have to take a short nap in the office during the day. I have to take care of my law firm too because there are people including my family have to depend on the law firm for survival.

There has been no case of this nature being fought through the court and mostly independence were achieved by colonists through wars and negotiations with colonialists.

Mauritius fought their case against UK for more than fifty years with about a hundred lawyers, law professors and big research team for their Chagos Islands. UK got many good international lawyers fighting against them. US also had interests in Chagos Islands because Diego Garcia is in the Chagos Islands, leased by UK to US for a military base after Chagos Islands being detached from Mauritius in 1965.

The case eventually reached the International Court of Justice (ICJ) where more than ten world well known jurists (Judges) hearing arguments of the case before Mauritius saw justice in their case.

Chagos Island case has different scenario from ours. Mauritius was granted independence by UK in 1965 on condition that Mauritius has to give up Chagos Islands to UK, but there are legal principles developed in this case, which became part of international law, decided by ICJ. All these procedures serving as precedent are helpful to advance our case.

Legal experts from many countries were invited to write their opinions to ICJ on this Chagos Island case.

I need your prayers and moral support and please do not condemn each other or party for any weakness in handling party matters. We are all part timers and we found it difficult to make things happen when we lacked the resources and manpower to carry on. We are not perfect. We still have to fight because no one will fight for us if we don't want to fight. Lack of resources and manpower should not hinder our struggles.

Please don't pull the party down or put the party in trouble.

Please understand PBK is a nationalist party and we are different from others. It is the only party that we hope could bring Sarawak independence by legal and political means.

The only way to do this is to ensure PBK captures the Sarawak government because only a political party who is in power and who controls the government and the Legislature, can be legally empowered to take certain legal and political actions to complete the task.

It is for this reason we had been trying to win in the last election to form the government, although we still could not win, not all is lost.

If I cannot complete this mission, I hope whoever helms the party must not deviate from the party struggle that was set on 8 June 2019 to move In Quest Of Independence to set Sarawak free and independent and to bring this MA63 Suit to international arena if the Malaysian Court rejects us.

To me, we have a very strong and arguable case for independence.

We have SUPP at one time fighting for Sarawak independence before Malaysian was formed in 1963 but the party didn’t continue to pursue their cause to set Sarawak free and independent due to political and security problems they faced by the party in 1960s.

Be reminded, our political enemies are not kind with us and it is their desire to see the party collapse or deregistered.

This could only happen if we are still not focused on our vision and mission for Sarawak independence or if we choose to betray the party.

God protects PBK, God protects Sarawak.
